6. Payments and Subscriptions

In no event shall our total cumulative liability to you exceed the greater of the amount you paid to us in the twelve months preceding the claim or one hundred Canadian dollars (CAD $100.00).

13.2 Termination by Us

We reserve the right to suspend or permanently terminate your access to the Service at our sole discretion, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent or abusive behavior, or if required to do so by law.

13.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue to apply, including but not limited to intellectual property rights, disclaimers, indemnification, and limitations of liability.

14. Governing Terms and Dispute Resolution

These Terms are governed by general principles of contract law applicable to online services operating internationally. In the event of any dispute arising out of or relating to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be made in writing and signed by an authorized representative of Tukameslov to be effective.
